Saskatchewan Entrepreneur Stream Latest News

* Saskatchewan immigration has conducted a new Entrepreneur stream draw, issuing 13 invitations through the Saskatchewan Immigrant Nominee Program (SINP). 


* The January 11th draw invited candidates with 120 points and a Canadian Language Benchmark score of 6 or higher to apply.  Expression of Interest (EOI) candidates will be invited on April 11, July 11th ,and October 10, 2024.  


OINP Latest Immigration News

On February 6th of this year, the Ontario Immigrant Nominee Program issued targeted notifications of interest to potential candidates who had a comprehensive ranking system (CRS) score of 379-430 and work experience in specific national occupational classification (NOC) codes.

Prince Edward Island Express Latest Immigration News

In January, 136 Invitations were issued to individuals working under the Express Entry, Skilled Worker and Critical Worker Streams with a minimum point score of 65. Invitations were issued to individuals working in Healthcare, Construction, Manufacturing, Food Processing, Agriculture, and Early Childhood Education sectors.


BC PNP Latest Immigration News

BC held two draws under their PNP program that targeted several streams including Tech, Healthcare, Construction, Childcare and Veterinary Care. The majority of the invitations were issued for the Tech stream (89). The Veterinary Care stream was a small group consisting of less than 5 individuals invited. The other three streams fell somewhere in the middle. 


Manitoba Special Immigration Measure - Ukraine Draw 

In response to the situation in Ukraine, the Manitoba Provincial Nominee Program will conduct regular EOI draws for individuals who meet all eligibility criteria and are affected by the ongoing events in that region. The following requirements must be met to be eligible:


* Are a Citizen of Ukraine

* Score at least 60 points according to MPNP assessment criteria

* Have a valid language test

* Have a minimum of CLB 4 in each language band

* Have an established connection to Manitoba 

* Can satisfy all other requirements of the Skilled Worker Overseas Pathway

Canada Study Permit Latest News 

Most post-secondary study permit applicants or participants in non-degree granting graduate programs such as certificate programs need a provincial attestation letter. However, some groups of students will be exempted: 

* Primary and secondary school students 

* Master’s or doctoral degree students visiting or 

* Exchange students in Canada 

* Study permit and work permit holders (includes study permit holders applying for an extension) in-Canada family members of study permit or work permit holders 

* Students whose application was received by IRCC before 8:30 a.m. ET on January 22, 2024 


Starting on February 15, 2024, a longer, 3-year Post-Graduate Work Permit (PGWP) will be available to those who are graduating from a master’s degree program that is less than 2 years and who meet all other PGWP eligibility criteria. 


The length of PGWPs for programs other than master’s degrees will continue to align with the length of the study program, to a maximum of 3 years.


No more SOWPs for those students attending college programs. These work permits will only be granted to spouses and common-law partners of students enrolled in master’s and doctorate programs as well as professional degree–granting programs only. The latter include undergraduate degrees that lead to entry-to-practice professions such as Law or Juris Doctor (LLB, JD, BCL) or Doctor of Medicine (MD).

New Brunswick Express Entry Latest Immigration News

Starting March 1, 2024, EOIs with the following NOCs will not be accepted: 

* 62010 – Retail Sales Supervisors

* 60030 – Restaurant and food service managers

* 62020 – Food Service Supervisors

* 63200 – Cooks 

Candidates with experience under the above NOCs can still use the AIP or NBPNP- Skilled Worker Stream

Recent Court Ruling – ICT Refusal Real Case

A case ruling at the beginning of the year provides a cautionary tale of what NOT to do when applying for a LMIA-exempt Work Permit. In a January judicial review presided over by Justice Little, a work permit refusal was upheld citing several specific reasons.  

First, the IRCC officer wasn’t satisfied with the requirements for LMIA exemption as an Intra-Company transferee. Essentially – the applicant didn’t provide a viable business plan or show how it would create significant benefits. In these cases, the responsibility falls on the applicant to provide the evidence and convince the Officer of his exemption eligibility. If an applicant cannot produce the necessary supporting documents, the court will not reassess the application. In this case, the judgment of the Officer was supported by the court, and the work permit refusal was upheld. 

Justice Little ruled the Global Case Management System (GCMS) notes were justified in questioning whether the “a work permit may be issued to a foreign national who intends to perform work that would create or maintain “significant ... economic benefits or opportunities” for Canadian citizens or permanent residents”. This provision is taken from paragraph 205(a) of the Immigration and Refugee Protection Regulations (IRPR). 

The applicant also failed to prove “Significant Benefit” and “Economic Benefit”. In assessing the proposed wages for the intended new hires, the officer determined that the wages were at or below the low end of the range for comparable positions in the Toronto region and would therefore make job creation unlikely. Ultimately, the court ruled in favor of the officer’s findings and the application was dismissed.
