No matter if you are from a high refusal region or a mature student, this is the only way to increase your chances to receive an approval for your study permit to Canada. Everyone knows it – but do you? Yes, you guessed it correctly, it’s converting from a visitor visa to a study permit from inside Canada.

Previously, if anyone had a valid visitor visa or visa-exempt passport, a study permit would be approved by default. But these days this is not the case all the time. Even if you have a valid visitor visa or are from a visa-exempt country, the approval rate is not 100% guaranteed for a study permit application.
The solution is simple if you fall into any of these categories:
* If you are already inside Canada and it’s been less than 6 months.
* If you are from a visa-exempt country like the US, Europe, Mexico, Korea, Japan, Chile, Israel, Brazilians with US visas, and so on.
* If you have a valid Canadian visitor visa.
* If you have a good profile or valid US visa, and can most likely receive a visitor visa to Canada as well.
* If you are the spouse or partner of a full-time international student or temporary foreign worker inside Canada, then you are eligible to convert/apply for a study or open work permit.
If you visit Canada, within the first 6 months of arrival and complete a pre-requisite to an academic program, then you can become eligible to apply for a study permit from inside Canada, with an approval rate of over +95% - in most cases 99%. The prerequisite can be, as an example, an English pathway course.
This means that regardless of your education gap, age, maturity, nationality, or inconsistent study plan you would still very likely be approved. The only reasons to fall within the 1% of refusals from inside Canada are if you:
* don’t meet the prerequisite requirements, or
* do not include proper supporting documents in your application, such as a conditional Letter of Acceptance (you can’t use one unconditional LoA) or
* have any misrepresentation on your application, or
* have previous issues with US or Canadian immigration, such as overstaying or removal orders, or criminality.
Even if you have a previous refusal for a study permit and you can get inside Canada with a visa or visa-exempt passport, then you can still apply from here if you meet the eligibility. It doesn’t happen a lot for somebody to have a valid Canadian visa and also be refused a study permit from abroad, but during this time, we have seen an increase in this type of refusals – especially for mature students.

The exact requirements to apply for a study permit from inside Canada are posted in the Immigration Refugee Protection Regulations (IRPR) subsection 215(1). The exact wording is as follows:
Application after entry
215 (1) A foreign national may apply for a study permit after entering Canada if they
(a) hold a study permit;
(b) apply within the period beginning 90 days before the expiry of their authorization to engage in studies in Canada under subsection 30(2) of the Act, or paragraph 188(1)(a) of these Regulations, and ending 90 days after that expiry;
(c) hold a work permit;
(d) are subject to an unenforceable removal order;
(e) hold a temporary resident permit issued under subsection 24(1) of the Act that is valid for at least six months;
(f) are a temporary resident who
(i) is studying at the preschool, primary or secondary level,
(ii) is a visiting or exchange student who is studying at a designated learning institution, or
(iii) has completed a course or program of study that is a prerequisite to their enrolling at a designated learning institution; or
(g) are in a situation described in section 207.
The key is to apply from inside Canada to take advantage of this high approval rate for study permits. If you can’t obtain a visitor visa or are not from a visa-exempt country, then perhaps you are looking at the wrong solution.
