Here are the potential solutions for applicants who are inside the US:
1: Have your spouse/partner come over and study a Graduate level program such as a Masters in either BC, Ontario, or Newfoundland that offer direct Canada PR after graduation without a job offer or experience. Only these 3 provinces offer such a program for direct Permanent Residency. And remember, PR is the status you gain just before you become eligible for Canadian citizenship
2: If you or your spouse can’t come over to study, and you find an employer in Canada who can assist you, then here are the options to look at:
* Intra-company transfer: if you are working with a multinational or a business that has a branch both in the US and Canada (if you’ve worked for the business for at least 1 year on payroll) there is the potential to move you over to the Canadian branch without an LMIA and for you to gain Canadian work experience and subsequently convert to PR.
* An employer can also offer you an LMIA, Labour Market impact assessment, to hire you so you can come over on a work permit to Canada. Depending on your profile, you can claim bonus points with this LMIA and job offer, and either in less than a year or after 1 year convert to Canadian Permanent Residency. Please remember that when one of the applicants has a permit such as a work or a study permit, their spouse/partner can become eligible to receive an open work permit as well. Many people think that LMIAs need to be issued from big companies, or have many people on the payroll. This is 100% not true and can be done with businesses of any size based on the financial health of the company alone.
3: Here is another option if you want to fast-track your way for Canadian PR: buy a business with at least 6-8 full-time Canadian staff, a minimum budget of $250,000 and higher, and claim your PR before you even arrive in Canada. It’s 100% possible and we’ve done it for our clients. Here are some key points to remember about immigrating to Canada, if you are on a temporary work permit or other types of status in the US:
1: If you are on the H1B visa, working full time for an employer, and don’t want to give up your US status, then you can have your partner/spouse convert to PR. The beauty of the Canadian system is that if your partner/spouse obtains a Canadian PR, you will too even if you have not spent 1 day in Canada before.
2: Another solution is that the whole family obtains their PR, and then sponsors you as a Canadian partner/spouse if you were unable to land with them in Canada during the original application process.
3: Remember, the US immigration and Canadian immigration share all the information about your file, so you cannot be in full-time employment in the US and at the same time be in full-time employment with your own company as an investor or even for another employer in Canada. 4: Here is an important point regarding Canadian PR status: after residing in Canada for a minimum of 3 years, you can become eligible for Canadian citizenship & passport. If you lived and worked here before you became a PR (such as a student or worker), you will get credit for these 3 years. If you studied or worked for 2 years on temporary status in Canada, you will get 1 year off the 3-year citizenship eligibility. Remember that you cannot jump from a work permit or study permit to Canadian citizenship. You can only convert from Permanent Residency (PR) to Citizenship.
It can take 3-5 months for a work permit to be issued from overseas, or you can apply from inside Canada after you arrive as a visitor. Study permits are faster if you apply from the US vs inside Canada, and work permits could be faster as well since all resources inside Canada are now processing Ukrainian work permits and visitor visas.
