These are the key criteria required for this category:
Significant investment in a business (each industry will vary but we will outline the investment amount below)
Jobs for Canadians must be created or maintained
Investment commitment should be at least C$250,000 unless more than 8 to 10 high paying jobs are created immediately
No Net Worth Requirement, no Source of Funds requirement
For existing businesses, Service Canada will check Salaries paid, Retained Earnings and Dividends
For new businesses, the Attestation by a CPA will be accepted
Where the Owner has 100% of the shares, depositing as much cash as possible into the Company bank account is advisable, to prove to the government of the genuine intentions of the applicant
Funds for investment must be committed before filing LMIA, i.e., could include a significant deposit and mandatory payments over time
Immediate points for Express Entry - 200 - if business is big enough, PR in less than 12 months is possible
LMIA Advertising required after March 31, 2021 – as an investor category
Live Anywhere in Canada (except Quebec)
No obligations after PR is received (The PR will be a different process/program)
The business should be “open and doing business” before they will approve an LMIA
If requesting NOC00XX positions, make sure that the business can support multiple divisions, each requiring a manager reporting to the NOC 00XX (NOC 00XX is used to obtain bonus 200 points in Express Entry)
With the above category you can enter Canada with your family in less than 6 months, potentially obtain 200 points (based on the business size and your profile) and proceed for fast-track PR through Express Entry if you meet the rest of the eligibility – even 557 points (from the latest Express Entry draw on July 6, 2022) can be achieved with a bonus of 200 points. Basically, with this category you should have an existing business in your home country or abroad with staff, payroll, and positive cash flow and assets. You will setup a branch office in Canada and move here to run it:
No minimum investment defined however ‘Significant Benefit’ for the Canadian economy should exist.
Off-shore company and Canadian company must be in an ownership and control relationship – that usually means that the same shareholders own at least 51% of both companies
Applicant must have worked for the company for at least 12 months outside of Canada within the last three years. Shareholders with at least 15% ownership are also eligible.
The Off-shore company must be able to afford setting up and supporting the company in Canada. Cost of first year operations in Canada include the cost of an NOC 00XX executive (unless you are not applying for a NOC 00).
Determination of affordability can include assets, not just Net Profit.
The business back home (i.e. the head office) must stay in business.
Canadian Company must have a business address and be incorporated.
Additional key employees can also be transferred to Canada.
After 12 months on Work Permit, 200 points for Express Entry can be awarded if the business is big enough.
If requesting NOC00XX positions, make sure that the business can support multiple divisions, each requiring a manager reporting to the NOC 00XX.
Setting up a Company bank account in Canada and transferring in funds, adds credibility to the application for a new company (of course we help with all these tasks and services).
If there is an existing Canadian company, even one recently acquired, ICT work permits will be issued for three years at the outset (not the typical renewable 1 year).
In principle, the total number of executives/workers transferred to Canada should not exceed the number of Canadians employed by the company, as this is a red flag for IRCC (so if you’re just the main shareholder, moving over, this is fine – as long as you have a manager or vice president or another shareholder back home who will take care of the business while you are in Canada – this is a strict requirement).
When we assess these cases for the ICT category, the size of the business back home is significant. If it’s too small or no payroll staff (no contractors considered) then we would suggest applying under the other 4 Federal investor work permit categories.
This is another great category for investors & entrepreneurs specifically for citizens of the following countries: US, Mexico, all European union member countries, United Kingdom, South Korea, Japan, Vietnam, Australia, Colombia, Chile, Peru, and Panama. These are called ‘treaty investors’ based on the Free Trade Agreements signed between two governments of the countries (i.e. Canada and your home country).
No LMIA required.
No Company outside of Canada required.
Minimum investment of at least C$250,000.
Must show source of funds.
Can bring additional persons to work in the business who do not have to be current employees, but they must be the same nationality as the Investor.
After 12 months on a Work Permit, 200 points for Express Entry can be received, if the business is big enough (similar to NOC 00 we explained in our previous categories - Otherwise any other NOC code would be 50 points for Express Entry)
The key point regarding this category: It is limited to specific countries, and you can pick up and apply for your investor work permit at the border (although we don’t recommend this at all – but rather to apply in advance through the embassy). The SIGNIFICANT ECONOMIC OR CULTURAL BENEFIT Work Permit under LMIA Exemption C10: This category is an interesting one. It is based on ‘Significant Benefit’ but this time it can be either economic benefit, social or cultural benefit. So this is good news for many entrepreneurs who are artists or are in the business of culture, arts, etc. This category is not limited to arts & culture only, but any economic significant benefit for Canada can also be included (i.e. hospitality, manufacturing, IT, construction, etc.)
Creation or saving of at least 10 jobs.
Do not have to be previously self-employed.
Can include multiple applicants with you in the application.
The minimum investment is basically outlined by the significant benefit and job creation for the industry that you will invest in.
The SIGNIFICANT BENEFIT work permit LMIA Exemption C-11 :
Can be a start-up.
Must have at least 2 years of successful self-employed experience in the immediate past and five years outside of Canada.
Usually for single entrepreneurs, not partnerships or groups.
Typically this category can include :
Export of goods made in Canada.
Cultural products and services for growing ethnic communities.
iii. Business Rescue (Owners will have to shut down without new investment).
Services to an under serviced area (growing subdivision, rural area, In-Home Senior Care, Daycare).
Job creation based on a unique service, unavailable in Canada.
