New Brunswick Entrepreneur Program

At one time New Brunswick was the only province with a security deposit entrepreneur direct Permanent Residence program. This meant that if you met eligibility requirements, submitted a business plan and proof of assets and made the $100K deposit your PR application would have been processed before arrival. Now, however, no such program exists anywhere in Canada. New Brunswick, like all other provincial programs, requires you to enter the province with a work permit, run the business, and then be nominated for permanent residency. As one of the only bilingual provinces in all of Canada, New Brunswick still has a lot of unique details in their program that set it apart.

New Brunswick Entrepreneur Program Eligibility Criteria  - Points Assessment

Similar to other provincial entrepreneur programs, you will need to claim points based on your profile and investment and submit an Expression of Interest (EOI) through the New Brunswick PNP website.

Any applicant seriously considering this program needs to meet 65 points out of a total of 100 to be eligible to be considered in the New Brunswick PNP pool. The points are allocated based on your age, education, net worth, language, business experience, and the business concept you are proposing, as well as several other factors.

* Age restriction: You must be between 21 to 59 years old. You cannot apply for this program if your age is outside of this range.  If this makes you ineligible in New Brunswick, there are more than a half dozen other programs in Canada which you can qualify for without an age restriction.

* Minimum education: A high school diploma is mandatory to be eligible for this program. Any additional education credentials will give you extra points for your EOI profile.

* Min. net worth: The basic eligibility here requires $500,000. The good news with this province, unlike Ontario, is that your spouse’s net worth can be included with yours as well.

This step requires a mandatory audit. You have 90 days from the time you receive an invitation to apply to hire one of the three designated Net Worth Verifiers (listed on page nine of the online guide.) After completing the audit, they will submit the report to the province. 

If you believe you do not meet the minimum net worth for this program, you can always consider other Federal programs which have no minimum net worth or audit requirements such as the Intra-Company Transfer which can be combined with the NB PNP skilled worker stream for PR or the Startup Visa program which is a direct PR program.

* Minimum language requirement You must show proof of a CLB 5 score in English or French at the time of application for your Expression of Interest, before you are invited.

* Minimum business experience You must have ownership or senior management experience for 3 out of the past 5 years. If you have more than 5 years of experience, you can claim your experience from the past 10 years. 

* In order to claim business ownership experience you need to have had at least 51% shares in your business, otherwise you can claim senior management experience instead.

New Brunswick Entrepreneur Program Eligibility Criteria  - The Business Plan

A proper business plan is required as part of your application to this program. The province will carefully review and allocate points based on the quality of your business plan. The business concept and investment should bring significant benefit to the province’s economy through at least one of these activities:

  1. increased value-added manufacturing or processing for New Brunswick exports; 
  2. enhanced research and development; 
  3. development of new products and/or services; 
  4. development of innovative approaches to traditional businesses; 
  5. development and/or enhancements of new technologies; 
  6. the transfer of technology and specialized knowledge to New Brunswick; 
  7. providing products and/or services to an under-served local or regional market; 
  8. immediate needs identified in specific regions or communities

Priority sectors and industries will have the highest chances of being invited for this program through the pool. These include:

1: manufacturing

2: information and communication technology (ICT)

3: cybersecurity

4: value added wood

5: agriculture or aquaculture

6: tourism

7: digital health

8: food and beverage

9: contact/call centers

10: energy innovation

11: aerospace and defense.

New Brunswick Entrepreneur Program Eligibility Criteria  - Additional Factors 

In addition to the eligibility requirements and business plan objectives, there are some additional factors that will play into the decision to approve your application. 

* Investment The minimum investment for this program is $150,000. There are a few considerations here: 

  • Working capital is not included. 
  • You can invest up to 25% in real estate, development or building up your business space you rented.
  • Inventory needed to run your business can be claimed - up to a maximum of 50% of your total investment (which would be considered from the start date of your business, not afterwards if you increase inventory. This means you need to purchase it all upfront before you start if you want to claim it as part of your eligible investment)
  • Professional services are only allowed from North American companies. Qualifying services can be claimed as 4% or $10,000, whichever is lower. 
  • Vehicles for your business can be claimed as 5% or $15,000 of your total eligible investment.

 

* Business Operation - There are several points which must be met here before you can be eligible to be nominated for your Canadian permanent residency. 

  • Demonstrate Viability – you must operate your company for a minimum of 12 months. 
  • Hold Controlling Stake - you need to have a minimum of 33.33% of shares in the business. You can invest or set up joint ventures with other Canadians in the province.
  • Create jobs – Your business has to create a minimum of at least 1 full-time job for a Canadian. Full time means 30 hours a week paid work. You should create more than one job if you want to be taken seriously in this program.

 

* Residency Requirements: Like all other provincial entrepreneur programs you are expected to stay in the province 75% of the entire 12 months before you are eligible to apply for your final PR nomination – while operating & managing your business. New Brunswick sets an additional limit that you must reside within a 100Km radius of your business location in the province.

* Exploratory visits are not mandatory but highly recommended if you do not have ties to the province and have not visited in the past 12 months. The province won’t consider anything less than 5 business days as an eligible exploratory visit, and they expect a detailed report regarding your meetings and visits for the trip. New Brunswick Entrepreneur Program - Extra Points Opportunities 

The best way to obtain the maximum amount of profile points is by claiming any additional eligible points in these categories:

A: Exploratory visit (5 points)

B: Higher quality business plan with proper research (8 points)

C: Minimum 5 years business ownership experience (4 points)

D: Spouse or partner language exam score of CLB (5 points)

That’s an additional 22-point boost to your profile points! The rest of the points will come from the areas mentioned above.

The New Brunswick PNP entrepreneur application processing fee is $2000 which needs to be paid to the PNP office directly only after you have received an invitation to apply. This fee is paid per application, not per family member or dependent.

New Brunswick Entrepreneur Program - Timelines

Timelines for the province of New Brunswick Entrepreneur business immigration program are as follows:

 

1: Your EOI will be valid for a maximum of 1 year in the pool.

2: You have 90 days to submit your supporting documentation after receiving your ITA.

3: You need to report to the province on arrival and start your business within 9 months.

4: You can submit your final report 12 months after actively running your business inside the province.

5: The nomination certificate processing can take 3-4 months approx.

 

New Brunswick Entrepreneur Program - Government Verification

In addition to reviewing your submitted documentation, an officer from the PNP office in New Brunswick will visit your business in person to check all criteria have been met. They will evaluate your business based on the economic considerations in New Brunswick including labor market and current industry inventory.  

The province of New Brunswick is very picky and biased in its selection of applicants for this entrepreneur program. They are one of the few provinces which prefer to select candidates from the pool, not based on their points, but rather based on their ties to the province and the type of business activity proposed.
